Birleşmiş Milletler'in ölenlerde işkence muayene usullerini ve standartlarını belirleyen Minnesota Otopsi Protokolü'nü (the Manual on the Effective Prevention and lnvestigation of Extralegal, Arbitrary and Summary Executions) kabulü, işkence olgularının uygun olmayan otopsilerle gizlenmesinin önüne geçmekte önemli rol oynamıştır. Canlılarda işkence izlerinin araştırılıp belgelenebilmesi için hazırlanan "İşkence ve Diğer Zalimane, İnsanlık Dışı, Aşağılayıcı Muamele veya Cezaların Etkili Biçimde Soruşturulması ve Belgelendirilmesi için El Kılavuzu" (İstanbul Protokolü), Birleşmiş Milletler belgesi oldu. BM Genel Kurulu'nda oylanıp uluslararası kabul gören bir protokol olma aşamasında. Protokol dünyanın 15 ülkesinden, 40 örgüte mensup 75 kişiden oluşan adli tıp uzmanı, hekim, psikiyatrisi ve psikolog, avukat ve insan hakları gözlemcilerinin ve çok sayıda bilim adamının katkılarıyla hazırlandı. 1996 yılında başlayan çalışmalar, protokolün, 20 Nisan 2000 tarihinde BM İnsan Hakları Komisyonu üyesi 52 devlet tarafından kabul edilmesine kadar 4 yıl sürdü. İlk BM Genel Kurulu'nda oylanıp kabul edilecek protokol, adli tıp uzmanlarını, psikiyatristleri ve avukatları yakından ilgilendirmektedir. Genel Kurul' da kabulünden sonra işkence iddiasının olduğu herhangi bir olgu, bu protokolle belirlenen usullere uyulmaksızın muayene edilerek rapor düzenlendiğinde, helam eksik iş yapmış ve görevini yerine getirmemiş sayılacaktır. İşkenceye maruz kalmış kişinin avukatının da müvekkilinin haklarını koruyabilmesi açısından protokolün uygun bir muayene ve değerlendirme için zorunlu olarak gördüğü koşulları iyi bilmesi gerekmektedir. Bu yazıda protokolde yer alan ve işkencenin saptanmasında önemli olan noktaları özetlemeye çalışacağız.

Acceptance of Minnesota Autopsy Protocol (the Manual on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions (United Nations publication. Sales No. E.91.IV.1), 1991) of United Nations which identifies the methods and standards of postmortem torture examination has played an important role in the prevention of concealment of torture evidence through improper autopsy reports. "Manual of Effective Investigation and Documentation of Torture and other kinds of Cruel, Inhuman and Denigrating Treatment or Punishments" (Istanbul Protocol) prepared to investigate and document evidence of torture has become a United Nations document. Currently, it is in the phase of being voted in the United Nations General Committee and become an internationally accepted protocol. The protocol was prepared with the contributions of 75 forensic medicine specialists, physicians, psychiatrists, psychologists, lawyers, human rights observers and scientists belonging to 40 organizations of 15 nations from all over the world. Operations started in 1996 and lasted 4 [year]s (April, 20, 2000) until the protocol was accepted by 52 nations which are members of UN Human Rights Commission. The protocol that will be voted and accepted in the first UN General Assembly is of great concern for forensic medicine specialists, psychiatrists and lawyers. Once the protocol is accepted, physicians writing examination reports of cases claiming signs of torture, without obeying the protocol items will be considered as performing malpractice. Furthermore, he/she will also be identified as providing an incomplete work. Lawyers of the torture victims should also be aware of the necessary conditions required for an appropriate examination and documentation (as proposed in the protocol) so that they will be able to defend the rights of their clients. In the following writing we are going to try to summarize the items of the protocol, which are important in terms of determining torture.
