CMUK'nun 399. maddesi sağlık nedeni ile ceza tehirinin kuralları ve sürecini tanımlamaktadır. Bu maddeye göre; ruhsal hastalığı olan mahkumların cezası iyileşme döneminin sonrasına ertelenir. Aynı madde ceza infazının gerçekleşmesi durumunda mahkumun yaşamını tehlikeye sokan hastalıklar için de geçerlidir. Yakın dönemde 399. madde, 2000 yılının Elam ayında başlayan açlık grevi eylemleri nedeni ile ülkemizin gündemine sıkça gelmiştir. Bazı mahkumlarda eylemleri sırasında oluşan vitamin eksikliği nedeniyle Wernicke-Korsakoff Sendromu gelişmiş ve 399. madde uygulanmıştır. Bu yazıda 399. maddenin açlık grevleri ve ruhsal hastalıklar bağlamında yorumlanması ve uygulaması tartışılmaktadır.

Article 399 of the Criminal Procedural Law defines the procedure and the rules of the suspension of a sentence by means of health excuses. In accordance with this article; if a person under the sentence has a mental disease, his/her penalty is suspended until the recovery. The same article is valid for a disease that endangers patient's life during execution of the sentence. The article 399 is currently applied for the persons who were in hunger strike since 2000 October. During their action; because of vitamin deficiency these patients developed Wernicke-Korsakoff Syndrome. In this paper we described the article 399 and its interpretation in the context of mental disease and hunger strike.
