Ceza sorumluluğu, yasanın suç saydığı bir eylem sebebiyle, eylemi işleyen kişide eylem anında aranan özelliklerdir. Bir kişinin cezalandırılabilmesi için ceza ehliyetine sahip olması gerekir. Suçun ve cezanın ne olduğunu bilerek ya da kavrayarak hareket etmeyen kişiye ceza verilemez. Cezanın etkili olabilmesi için cezadan ders alınması ve cezanın anlamının bilinmesi gereklidir. Burada karşımıza ceza ehliyeti kavramı çıkmaktadır. Bu kavram yaş, sağır-dilsizlik, akıl hastalığı, zeka geriliği, arızi sebepler gibi bir çok faktörden etkilenir. Bu yazıda adli psikiyatrik açıdan ceza ehliyeti konusu ele alınacaktır.

Criminal responsibility is the total of features those are looked for at the moment of the crime in a person who has committed a blameworty act. A person who is acting without comprehension and understanding of crime and punishment can not be penalized. In order to the punishment be effective the penalized person must have an understanding of punishment and learn a lesson from it. At this point the concept of criminal responsibility is faced. This concept is effected from many factors such as age, deafness, muteness and mental disorders. In this paper the concept of crimi¬nal responsibility is discussed in the context of forensic psychiatry.
