Türkiye'de son altı yılda sürücü davranışının değerlendirilmesinden geliştirilmesine doğru değişen bir yasal düzenleme süreci yaşanmıştır, ancak bu düzenlemelerde uygulamaya yansıyan önemli sorunlar bulunmaktadır. Yapılan ilk düzenlemelerde psikoteknik değerlendirmenin kapsamı sınırlandırılmış ve bu değerlendirmeye dayanan sonuçların sürücüyle ilgili kararlara yansıması engellenmiştir. Ayrıca, alkollü sürücülerle ilgili düzenlemeler bir başka yasa maddesiyle çeliştiğinden, bu grubun sürücü değerlendirmesine alınmasına ilişkin prosedür işletilememiştir. Sonuç olarak, değerlendirmeye alınan ihlalci sürücülerin % 99'undan fazlası yeterli bulunmuş ve tüm ihlalci sürücülerin yalnızca % .62'sini alkollü sürücüler oluşturmuştur. Ocak 2003 tarihindeki yeni düzenlemelerle alkollü sürücülerin değerlendirmeye alınması konusuna çözüm getirilmiş ve bu gruba yönelik zorunlu "davranış geliştirme eğitimi" önlemine yer verilmiştir. Bununla birlikte, belirtilen diğer sorunlar hala çözümlenmemiştir ve davranış geliştirme eğitiminin detayları henüz belirlenmemiştir. Bu yazıda, sürücü değerlendirme işlemlerindeki sorunlar sayısal verilere dayalı olarak ele alınacak ve davranış geliştirme programlarının temel gereklilikleri Avrupa ülkelerindeki uygulamalar dikkate alınarak tartışılacaktır.

There has been a legislation process in the last six-year period involving a change from driver assessment to driver improvement programs in Turkey. Overall regulations, however, possess certain limitations, which influence practice negatively. In the initial legislations, the content of the psycho-technical examination had been restricted and this restriction resulted in an inability in making clear and comprehensive evaluation about the tested drivers. In addition, since the regulation concerning the drunk drivers was in conflict with another article in the Traffic Law, the initial legislation requiring the assessment of drunk drivers could not be practically applied. A recent report on the application of psycho-technical assessment indicated that more than 99 % of the drivers referred to psycho-technical assessment centers were found to be "normal", and among the whole offenders only .62 % consisted of drunk drivers. By the January 2003, the changes in Traffic Law have brought a solution for the assignment of drunk drivers to driver assessment process and mandated "behavior improvement" program as a new application area. However, the problems and limitations remained unsolved and details of behavior improvement programs have not been clarified yet. In this paper, problems in the driver assessment process in Turkey are summarized and discussed on the basis of the quantitative data. The basic requirements and the functions of the behavior improvement programs are also discussed in comparison with the practice in other European countries.
