Ülkemizde adli psikiyatri uzmanı olmadığından bütün psikiyatri uzmanlarının aynı zamanda adli psikiyatri raporu yazmakla görevlendirilme
olasılığını göz ardı etmemek gerekir. Bu nedenle psikofarmakoloji ve diğer tüm klinik bilgiler gibi adli psikiyatri bilgisinin
de dağarcığımıza eklenmesi zorunlu. Hukukla ruh hekimliği bilgisinin bir ortak çalışma alanı olarak adli psikiyatri; önemi gittikçe artan
bir çalışma alanımız. Bu resmi görevi üstlendiğimizde hukukun ne istediğini ve psikiyatri bilgisinin bu işlevi gerçekleştirirken nasıl
uyarlanacağını bilmemiz gerekiyor. Yargılama sürecinde ruh hekimi değerlendirilecek bir kanıtın saptanması ile görevlidir. Adli psikiyatrik
rapor düzenlemede hangi hastalığa ne tür bir rapor düzenleneceği sorusu doğru değildir. Ruh hekiminin görevi değerlendirilen
kişinin suçlu olup olmadığı değil, yargılamaya konu olan psikiyatrik durumun var olup olmadığıdır. Adli psikiyatrik raporun dili gündelik
dil olmalıdır. Ruh hekimlerinin yazacağı doğru ve güvenilir raporların Adli Tıp Kurumu'nun raporlarının daha güvenilir olduğu
yönündeki yanlış kanıyı da düzelteceği bir gerçektir. Adli psikiyatrik değerlendirme ile kanıt oluşturma süreci dört aşamadan oluşur:
Hukuk dilinin psikiyatri diline çevrilmesi, psikiyatrik değerlendirme, psikiyatrik sonucun hukuk diline çevrilmesi (adli psikiyatrik
rapor), yargıcın psikiyatri bilgisiyle yazılıp, hukuk diline çevrilmiş metni anlaması. Yazıda iki örnek (ceza sorumluluğu ve cinsel suç
mağdurlarının değerlendirilmesi) üzerinden iki bilim alanının dilleri arasındaki çeviri işlemi açıklanmıştır. Adli psikiyatrik rapor düzenlemede
de 'hastalık yok, hasta var' geçerlidir, kişiye ve duruma göre rapor düzenlenmesi gerekir. Adli psikiyatrik raporların duyarlı bir
inceleme ve incelikli bir yazımla düzenlenmesi gerekir. Tanı, hukuki sorunun yanıtı bütün gerekçeleri ile raporda yer almalıdır.

We must regard that all of psychiatrists may be assigned to write a forensic psychiatric report due to lack of forensic psychiatrist. It is a
necessity to add knowledge of forensic psychiatry to curriculum beside psychopharmacology and the other clinical information. Forensic
psychiatry as mutual study area of justice and psychiatry is also our practice fi eld. When we are taken on this formal task, we must know
what justice demands from us and how we adapt the psychiatric knowledge to this function. Mental health specialist is charged with
to determine the proof for court. It is not a correct question, what kind report is prepared for which disorder in forensic psychiatry.
Psychiatrist's task is not to detect whether the referred person is guilty or not. In contrast, it is whether does exist or not the psychiatric
condition is the subject of judgment. Th e wording of the reports has to be not terminologically but must be in daily tongue. It is a truth
that correct and reliable reports written by psychiatrists will ameliorate the myth about reports of Institution of Forensic Medicine are
more reliable. Th e process of determining the proof by forensic psychiatric evaluation consists of four stages: Translation the notion
of law to psychiatric notion, psychiatric evaluation, translation the psychiatric result to notion of law (forensic psychiatric report) and
understanding of judge the report text. In the paper, it has explained the translation procedure between the notions of two science area
on two examples (criminal responsibility and evaluation of victims of sexual assaults). Th e motto of ?patient exists, not disease? is valid
in forensic psychiatry; it is a must to prepare specifi cally the report according to person and condition. Report must be prepared after a
sensitive investigation and with refi ned spelling. Diagnosis and answer of judicial question must get involved in the report.
