Amaç: Bu çalışmada 11-15 yaş grubundaki çocukların cinsel suç işlemesinde etkili olan faktörlerin belirlenmesi amaçlanmıştır. Yöntem: 1994 yılında İstanbul Çocuk Mahkemelerinde yargılanan 11-15 yaş grubu toplam 2281 çocuk içerisinde cinsel suç işlemiş 92 çocuğun yaş, cinsiyet, eğitim ve meslek durumları gibi sosyodemografik özellikleri, suçun anlam ve önemini kavrayabilme (farik ve mümeyyizlik) durumları ve suça ilişkin özellikler (suç öyküsü, suç türleri, suçun işleniş şekli, suçun kime karşı işlendiği) değerlendirilmiştir. Sonuç: Cinsel suç işleyen olguların %99'u erkeke, %1'i kız çocuğudur. En sık suç işlenen yaş erkek çocuklarda %47.3 oranıyla 14 yaştır. Suç işleyen tek kız çocuğu ise 15 yaşındadır. Yargılanan çocukların %48.9'unun ilkokulu bitirdikleri, %63.7'sinin vasıfsız işçi olarak çalıştıkları saptanmıştır. En sık işlenen suç türü "ırz ve namusa tasaddi" (%33.3) olup, Türk Ceza Kanunu'nun 415. maddesi kapsamında değerlendirilmiştir.Suçlar %63 oranında rıza ile işlenmiş olup, %87 oranında yargılanan çocuk ile suçun yöneldiği çocuğun önceden birbirini tanıdığı belirlenmiştir. Tartışma: Bu araştırmada olduğu gibi, yapılan birçok araştırmada, yetersiz eğitim düzeyi ile suçluluk arasında yüksek korelasyon saptanmıştır.

Objective: The purpose of this study was to investigate the etiological factors in juvenile sexual crimes. Method: 92 cases out of 2281 juvenile cases in the 11-15 age group, who were convicted of sexual offences in Istanbul Juvenile Courts during 1994 have been evaluated according to various personal attributes such as age, sex, education, occupation, criminal history and criminal responsibility as well as the characteristics of the crime (such as type of crime, he nature of its execution, identity of the victim). Results: The results showed that sexual offences were more frequent among the male convicts (99%). Forty three (47.3%) boys were at the age of 14 and the only one girl was 15 [year]s old. 48.3% had primary school education and 63.7% were employed in manual labour. The most common crime type was shown to be sexual abuse (33.3%) and was evaluated acording to Act 415 of the Turkish Criminal Code. In 63 % of the sexual crime cases, the victims were reported to be willing and in 87% of the crimes, the offender and the victim were found to be previously acquainted. Discussion: TAs in many other studies, the correlation between sexual crime rates and insufficient education were remarkable.
