Bu çalışmada ilk olarak ötanazinin Eski Yunan'da ve bugün batı kültüründe içerdiği anlam ortaya koyulmuştur. İkini olarak ötanazi tartışmalarında karşılaşılan aktif-pasif, istemli-istemli olmayan-istem dışı ötanazi ayırımları üzerinde durulmuştur. Bu çerçevede sadece pasif ötanaziyi hukuka ve ahlaka uygun sayan ve bu nedenle aktif-pasif ayırımının korunmasını öngören yaklaşımın gerçekçi olmadığı vurgulanmıştır. İstemli ötanazinin ve sınırlanmış istemli olmayan ötanazinin hukuka uygun olması gerektiği savunulmuş, istem dışı ötanazinin ise hiç bir hukuk düzeninde kabul edilemeyeceği belirtilmiştir. Üçüncü olarak da ötanazinin temel sorunu olan yaşam hakkı-ölme hakkı çatışması üzerinde durulmuştur, Yaşam hakkının bireyin kendisi tarafından vazgeçilebilecek bir hak olduğu vurgulanmış, fakat bu noktada bireyin hata yapma olasılığına karşı devletin koruyucu rolünün ortaya çıktığına değinilmiştir. Yaşam hakkından feragatin ancak güvence mekanizmaları getirilerek tanınabileceği kabul edilmiştir.

In this essay, firstly, the meaning of euthanasia in Ancient Greece and today in western culture has been shown. Secondly, the euthanasia distinctions such as ac- tive-passive, voluntary -non-voluntary- involuntary euthanasia has been examined. In this context, it is emphasized that the approach which claims that only passive euthanasia is legally and morally justifiable, and which insists on keeping the active-passive distinction in not rational. After explaining voluntary, non-voluntary, involuntary euthanasia concepts, it has been defended that there is no strong reasons not to justify voluntary euthanasia and restricted non-voluntary euthanasia. On the other hand, it is sure that involuntary euthanasia can not be accepted in any legal system. Thirdly, the right to life and right to die conflict which is the basic problem of the euthanasia case has been examined. It has been concluded that the right to life can be waived by the individual's self but the patemalistic role of the state which prevents the individual from causing significant harm to oneself can not be neglected. Therefore, the waiver of the right to life, in other words the right to die should be legitiniate bringing all possible safeguards.
