Cinsel suçlar son yıllarda diğer şiddet suçlarına göre daha çok dikkat çekmeye başlamıştır. Toplumun ve medyanın daha fazla tepki vermesi nedeniyle dünyada ve ülkemizde yasalar değişmeye başlamıştır. Psikiyatrlardan daha çok tıbbi görüş istenmeye başlanmıştır. Cinsel suç işleyenlerde ceza sorumluluğu olup olmadığı ya da cezaevinde bulunuyorsa tedavi gerektiren ruhsal hastalık olup olmadığı konularında, cinsel suç mağdurlarında ise suçun anlamını bilip bilmediği ya da kendisini savunup savunamayacağı konularında rapor düzenlenmesi istenebilir. Mağdurun ruh sağlığının bozulup bozulmadığının tespiti ise yasa değişmesine rağmen halen bazı mahkemeler tarafından sorulmaya devam etmektedir. Adli psikiyatri uygulamalarında hem cinsel suç işleyenlerin hem de cinsel suç mağdurlarının değerlendirilmesi yapıldığından, bu konularda psikiyatrın hem yasal mevzuatı hem de bu olguların özelliklerini iyi bilmesi gerekmektedir. Bu nedenle, bu yazıda hem suç işleyenler hem de mağdurların bilirkişilikte nasıl değerlendirilmeleri gerektiği konusu literatür bilgileri ve pratik deneyimler ışığında derlenmiştir.

Forensic and administrative expertise on sexual issues: the approaches to sex offenses and sexual victims as a psychiatrist In recent years the sex offenses have attracted more attention when compared to other violent crimes. Due to the society and the media response more laws were being changed both in the world and our country. The psychiatrists have begun to be asked more medical opinion. About the sexual offenders, reports may be asked about whether they have criminal responsibility or not. If these offenders were in prison then reports may be asked for a report whether they have a mental illness which deserves treatment. For the sexual victims, also reports may be asked for whether they know the meaning of offence or they may defend themselves. Although the legislation is changed there are some courts still asking for the determination of whether the victims'mental health is deteriorated or not. Because the assessments of both the offenders and the victims of sexual offenses are performed by the forensic psychiatrist, in these issues the psychiatrist needs to know better the legislation and the characteristics of these patients as well. Therefore the subject of how the offenders and the victims should be considered on the expertise was reviewed in light of literature, laws and practical experiences in this paper.
