Ruh hekimlerinin uğraş alanındaki hasta ve danışanlarının, tıbbi ve toplumsal durumları şiddete, genel nüfusa göre daha açıktır. Hastalarımız kısmen de olsa ortalamadan daha fazla şiddete başvururlar. Hastalarımıza büyük oranda ortalamadan daha fazla şiddet uygulanır. Bu nedenle hekimler hastaların muayeneleri sırasında, yaşamlarında ve başvuru nedenleri içinde şiddetin yerini öğrenmek için daha meraklı olmalıdırlar. Hekimin şiddet içeren bir davranışa veya bunun sonuçlarına tanık olması halinde görev alanı ve anlayışı, insan haklarına saygısı, yasal yükümlülükleri ve etik kurallar gereği yaklaşımı üç kademeden oluşur: Öncelikle acil tıbbi yardım sağlanır. İkinci olarak uygulanan şiddetin ailevi, polisiye, toplumsal ve yasal düzeneklerden biri ya da birkaçı kullanılarak devamı engellenmeye çalışılır. Son olarak mağdurun korunması ve sanığın cezalandırılması için gerekli güvenlik ve hukuksal süreçlerin başlatılması sağlanır. Yasal ve etik kurallar, ister hastamız uygulamış olsun, ister hastamıza uygulanmış olsun; öldürme, öldürmeye kalkışma, ağır yaralama, cinsel saldırı, cinsel istismar suçlarının varlığında hekimin mağdurun korunması ve sağaltımı ile saldırganın önlenmesi, cezalandırılması ve gerekiyorsa sağaltımı için gerekli yönetsel, hukuksal ve tıbbi girişimlerin başlatılmasını sağlamakla veya başlatmakla yükümlüdür. Bu yükümlülüğün iki istisnasından birincisi basit tıbbi girişimle düzelebilecek yara ve berelenmeleridir. İkincisi ise gerekli girişimlerin başlatılması gerektiği halde, maruz kalanın olayın deşifre olmasını istememesi için öne sürdüğü gerekçelerin haklılığı olabilir. Burada ortaya çıkan yasal ve etik çelişkilerde; hekim ikilemini aklı, vicdanı ve evrensel etik ilkelerin ışığında çözecektir. Ancak etik olarak doğru olanın yasal olarak sorumluluk doğurması olasılığı göz ardı edilmemeli, bu durumlarda kişiyle iletişim ve yazılı kayıtlara özen gösterilmelidir.

The medical and social positions of psychiatrists are more exposed to violence by their patients and clients, in comparison to the general population. Our patients use violence somewhat a little more frequently than the general average. And our patients are exposed to violence more than average. For this reason, psychiatrists should be more curious about the position of violence in the lives of their patients and reason of admittance of their patients. The approach of a psychiatrist to a violent behavior or its consequences when he/she is wittness to such an act consists of three components, in accordance with his/her area of responsibility, comprehension, respect to human rights, legal obligations and ethical rules: First of all, emergency medical aid is provided. Secondly, an attempt at preventing the continuation of the violence should be tried, by the help of one or more of the familial, sociological, legal mechanisms and police force. Lastly, the security of the aggrieved person should be established and legal procedures for punishment of the criminal act should be initiated. Legal and ethical rules are responsible for or initiation of the necessary administrative, legal and medical procedures required for protection and treatment of the physician or aggrieved person, and prevention, punishment and if necessary, treatment of the aggressor, in the presence of crimes such as homicide, attempt at homicide, severe injury, sexual assault or sexual harassment, either done by or done to our patients. One of the two exceptions in this process is the presence of light injuries or bruising that may easily heal with simple interventions. A second exception may be the legitimacy of the rationale that the aggrieved may present in order not to announce the incident, even though obligatory steps have to be initiated. In cases of legal and ethical contradictions that arise in such cases, the psychiatrist will solve the problem in light of his intellect, his conscience and universal ethical rules. The possibility that what is right from an ethical point of view may create legal liabilities on the other hand should not be ignored, and care should be taken in continuous personal communication with the person and written records.
