Alkol ve madde kullanım bozukluğunun adli süreçlere pratikte yansıması

Alkol ve madde kullanım bozukluğu (AMKB) sadece kişinin sağlığı için değil, bireysel ve toplumsal sorunlara yol açması sebebiyle de yasal
mevzuatta önemli yer tutar. Psikiyatrik uygulamalarda gerek bilirkişilik gerekse tedavi açısından alkol ve madde kullanımının değerlendirilmesi
giderek daha sık yer almaktadır. Bilirkişilikte, alkol ya da madde kullanımının ceza sorumluluğuna etkisi veya alkol-madde kullanımı ya
da bağımlılığının tespiti istenmektedir. AMKB olanların tedavisi ise mahkeme kararları ile ya şartlı ya da zorunlu tedavi şeklinde olmaktadır.
Bu yazıda, AMKB’ye ilişkin bilirkişilik ya da tedavilerle ilgili yasal mevzuat ve uygulamalar derlenmiştir. Ayrıca rapor örnekleri verilmiştir.
The reflection of substance use disorder on forensic processes in practice
Substance use disorder (SUD) is not only important for personal health but also important for the legislation because it conduce social
and individual problems. Either from the point of expertness or from the point of treatment, the evaluation of alcohol and substance use
often takes a part in the psychiatric practice. In the expertness, the impact of alcohol and substance use on criminal responsibility or the
determination of alcohol and substance use or addiction is asked. The treatment type of alcohol and substance is determined by court.
According to this, conditional or compulsory treatment is applied to the patients. In this paper, the legislations and psychiatric practice
related with SUD is reviewed. In addition to this, report samples are given.
