Türkiye’de mahkemelerin, bilimin nesnel ve yol gösterici konumundan yararlanma talebi giderek artan bir eğilim olarak gözükmektedir. Hukuk tarafından yönetilen sorulara yanıt verecek olan adli psikiyatri uzmanının nesnel ve yol gösterici konumu, psikiyatri biliminin nesnelliği ölçüsünde olacaktır. Bu yazıda “oğlunun babası tarafından cinsel istismar”a uğradığı iddiası nedeniyle mahkeme tarafından ruhsal durum muayenesi istenen bir kadın olgudan sözedilecektir. Psikiyatrik muayenelerde, bir düşünce sisteminin “sanrı” olarak değerlendirilebilmesinin nesnel ve bilimsel duyanakları tartışılacaktır

In Turkey, the courts have an increasing tendency towards the use of the objectivity and the leader-ship of science. The objective and leading position of the forensic psychiatrist who is in charge of answering the questions of the court, will have a direct relationship with the objectivity of the psychiatry. This paper presents a case who claimed that her husband abused her son sexually and who was sent by the court for present mental state examination. It discusses the objective and scientific criteria of the assesment of an idea as a “delusion” during psychiatric examinations.
