Amaç: Fârik ve mümeyyizlik (Suç Farkındalığı) durumunun saptanması için bilirkişiye gönderilen çocukların suç davranışlarını, sosyodemografik özelliklerini ve aile özelliklerini incelemeyi amaçladık. Yöntem: 2001 yılı Mart, Nisan, Mayıs aylarında Dicle Üniversitesi Tıp Fakültesi Psikiyatri Anabilim Dalı’na ve Diyarbakır Adli Tıp Şube Müdürlüğü’ ne gönderilen 165 (3 kız, 162 erkek) çocuğun hepsi çalışmaya alındı. Bilgiler tarafımızdan hazırlanan yarı yapılandırılmış bir form yardımıyla tek tek görüşülerek elde edildi. Bulgular: Çocukların yüzde 97’ si işlediği suçun bilincindeydi. Suçun işlenme zamanında çocukların yüzde 33’ ü 14 yaşındaydı. En sık işlenen suçlardan hırsızlık yüzde 52, yaralanma yüzde 20 oranındaydı. Çocukların yüzde 21’ inde daha önce benzer veya farklı bir suç işleme, yüzde 14,5 ‘ inde kardeş suçluluğu, yüzde 36’sında sigara içme, yüzde 21’ inde evden kaçma, yüzde 28’ inde göç yaşama öyküsü vardı. Göç yaşayan çocuklarda eğitimin aksaması sorunu ve hırsızlık suçu daha belirgindi. Çocukların yüzde 5.4’ ünde hafif şiddette psikiyatrik bozukluk saptandı. Yüzde 51’ i şu an okula gitmemekteydi. Yüzde 53’ ü para kazanmak için bir iş yapmaya çalıştığını bildirdi. Çoğu kalabalık aile ortamında büyümekteydi ve kardeş sayısı ortalaması 7,4 idi. Çeşitli nedenlerle yüzde 19’ unda anne-baba birlikteliğinin kaybolduğunu saptadık. Ebeveynlerin çoğunun ekonomik durumu ve eğitim düzeyi düşüktü. Tartışma: Suç davranışları dışında, çocukların büyük çoğunluğunda bedensel ve ruhsal yakınma saptamadık. Çoğu işledikleri suçun bilincindeydi. Ailenin gelir ve eğitim düzeyi düşüklüğü, anne-baba denetiminin bozulması, göç yaşantısı, suç tekrarı, yakın akrabalarda suç hikayesi ve sigara alışkanlığı gibi durumları risk etkeni olarak kabul edilebiliriz. Bu nedenle, suçlu çocukların rehabilitasyonu ve yeni oluşacak suç davranışlarının önlenmesi ile ilgili önlemler alınırken risk etkenlerinin göz önünde tutulmasının yararlı olacağını düşünmekteyiz.

Objective: We aimed to determine sociodemographic features, family characteristics and offense behaviors of the juvenile offenders that were sent to the expert to find out their awereness of the committed crime. Method: A total of 165 (3 girls and 162 boys) juveniles who were sent to the Department of Psychiatry, in Dicle Universty, Medical Faculty, and to the Judicial Physician in Diyarbakir Judicial Organ during a period of 3 [month]s between March-May 2001 were included in this study. The information was obtained through a semi- structured questionnaire prepared by us, by interviewing with all children oneüby one. Results: Ninety seven percent of juveniles were aware of the committed crime. The most frequently committed crimes were theft (52 percent) and wounding (20 percent). Of the juveniles, 33 percent were 14 [year]s old at the time of the committed offense; 21 percent had history of a similar or different offense behaviors; 14,5 percent had sibling offender; 36 percent had smoking habit; 21 percent had history of escape from home; and 28 percent had internal immigration history. Theft and discontinuation to education were more prominent in juveniles who immigrated. There were mild psychiatric disorders in 5,4 percent of juveniles. Of the children, 51 percent were not going to school at the time of offense behavior, and 53 percent reported that they tried to do many kind of works to earn money. Most of them were grown up in a crowded family environment, and the average number of sibling was 7,4 In 19 percent, the unity of the parents was broken up due to certain factors. The economical and educational levels of most of the families were low. Conclusion: We detected no somatic and psychiatric disorders, in most of those children except for those offensr behaviors. Most of them were aware of their committed offense. We can accept some features as risk factors: Low income and educational levels of the family, loss of parents’ control, immigration history, repetition of the offense behavior, smoking and offense history within their relatives. Therefore, we think that it would be useful to take these risk factors into consideration for the rehabilitation of the juvenile offenders and for the prevention of future offense behaviors.
